Gizmonote is a hosted point-and-comment feedback widget operated by Proxy (madebyproxy.com). By adding the widget to a site or using the service, you agree to these terms. Plain-English summary below; if anything here doesn't work for you, don't use the service.

1. The service

We provide a hosted widget and backend that let people leave visual comments on a web page. Comments and any images you attach are stored on our infrastructure and are shared and visible to anyone who opens the tool on that page. There is no private or encrypted mode.

2. Don't put sensitive data in it

Because comments are open and shared by design, do not use Gizmonote for confidential, personal, regulated, or otherwise sensitive information (no passwords, payment data, health data, or personal data of others). You are responsible for what you and your visitors submit.

3. Acceptable use

You agree not to:

We may rate-limit, remove content, suspend, or terminate access for any account or site that abuses the service, at our discretion.

4. Free tier & changes

A free tier is offered as-is and may include usage limits (comments, storage, requests, sites). We may change, limit, add paid plans to, or discontinue the free tier or any feature at any time. We'll try to give reasonable notice of material changes.

5. Ownership & license

The Gizmonote widget, loader, backend, and all related code and branding are the proprietary property of Proxy and are protected by copyright. They are not open source. You are granted a limited, revocable, non-exclusive right to embed the hosted widget on sites you control while these terms are in effect. You may not copy, modify, redistribute, resell, sublicense, reverse-engineer, or self-host the code without a written license from Proxy. You keep ownership of the comment content you submit, and grant us the license needed to store, display, and operate the service.

6. No warranty

The service is provided "as is" and "as available," without warranties of any kind. We don't guarantee it will be uninterrupted, error-free, secure, or that data will never be lost. Keep your own copy of anything important.

7. Limitation of liability

To the maximum extent permitted by law, Proxy is not liable for any indirect, incidental, or consequential damages, or for lost data or profits, arising from your use of the service. Our total liability is limited to the amount you paid us for the service in the prior 12 months (which, on the free tier, is zero).
